1. Taraflar ve kapsam
Bu şartlar Magic Art Studio uygulamasının ("Uygulama") kullanımını düzenler. Uygulamayı sağlayan: Türkiye'de yerleşik bireysel geliştirici Deniz Şengül ("biz"; iletişim: support@denizsengul.com). Uygulama çocuklara yöneliktir; çocuğun kullanımından ebeveyni veya yasal temsilcisi sorumludur ve bu şartları onun adına kabul eder. iOS'ta ayrıca Apple'ın Standart Son Kullanıcı Lisans Sözleşmesi geçerlidir.
2. Lisans
Size Uygulamayı kişisel ve ticari olmayan amaçla kullanmanız için devredilemez, münhasır olmayan bir lisans veririz. Uygulamadaki karakterler, çizimler, sesler ve yazılım bize aittir. Çocuğunuzun Uygulamada oluşturduğu eserler size aittir.
3. Ücretsiz sürüm ve Premium abonelik
- Uygulama ücretsiz indirilir ve oynanır. Ücretsiz sürümde (yalnızca Android'de) çocuğa uygun reklamlar gösterilebilir.
- Premium; reklamsız deneyim ve ek içerik (boyama sayfaları, renkler, fırçalar, sticker'lar, çerçeveler, sihirli efektler) sunan, otomatik yenilenen aylık veya yıllık bir aboneliktir.
- Ücretsiz deneme: Uygun kullanıcılar için 3 gün. Deneme bitmeden en az 24 saat önce iptal edilmezse abonelik ücreti mağaza hesabınızdan alınır.
- Ödeme ve yenileme: Ödeme Apple App Store veya Google Play üzerinden alınır. Abonelik, dönem bitmeden en az 24 saat önce iptal edilmezse aynı süre ve o anki fiyatla otomatik yenilenir.
- İptal: iOS'ta Ayarlar → Apple Kimliği → Abonelikler; Android'de Google Play → Ödemeler ve abonelikler → Abonelikler. Uygulamadaki "Aboneliği yönet" düğmesi de bu ekranı açar. Hesabın silinmesi aboneliği iptal etmez.
- İadeler: İlgili mağazanın iade politikasına tabidir.
- Satın alımları başka bir cihazda Ayarlar → Ebeveynler → Satın alımları geri yükle ile geri yükleyebilirsiniz.
4. Hesap
Hesap isteğe bağlıdır ve yalnızca bir yetişkin tarafından açılabilir. Hesap bilgilerinizi gizli tutmak sizin sorumluluğunuzdadır. Hesabınızı istediğiniz zaman uygulama içinden veya bu sayfadan silebilirsiniz.
5. Kabul edilemez kullanım
Uygulamanın tersine mühendisliği, izinsiz kopyalanması, satın alma veya güvenlik mekanizmalarının atlatılması ya da hizmetin kötüye kullanılması yasaktır.
6. Sorumluluğun sınırlandırılması
Uygulamayı özenle geliştiriyoruz, ancak kesintisiz veya hatasız çalışacağını garanti edemeyiz. Yürürlükteki mevzuatın izin verdiği ölçüde dolaylı zararlardan sorumlu değiliz. Tüketici olarak sahip olduğunuz yasal haklarınız saklıdır.
7. Değişiklikler ve uygulanacak hukuk
Bu şartları güncelleyebiliriz; güncel sürüm bu sayfada yayınlanır. Türkiye Cumhuriyeti hukuku uygulanır; tüketici uyuşmazlıklarında tüketici hakem heyetleri ve tüketici mahkemeleri yetkilidir.
8. İletişim
1. Scope
These terms govern the use of the Magic Art Studio app (the "App"), provided by Deniz Şengül, an individual developer established in Turkey ("we"; contact: support@denizsengul.com). The App is directed to children; a parent or legal guardian is responsible for the child's use and accepts these terms on the child's behalf. On iOS, Apple's Standard End User License Agreement also applies.
2. License
We grant you a personal, non-commercial, non-transferable, non-exclusive license to use the App. Characters, artwork, sounds and software in the App belong to us. Artwork your child creates in the App belongs to you.
3. Free version and Premium subscription
- The App is free to download and play. The free version may show child-appropriate ads (Android only).
- Premium is an auto-renewing monthly or yearly subscription with an ad-free experience and extra content (coloring pages, colors, brushes, stickers, frames, magic effects).
- Free trial: 3 days for eligible users. Unless canceled at least 24 hours before the trial ends, the subscription price is charged to your store account.
- Payment and renewal: Payment is made through the Apple App Store or Google Play. The subscription renews automatically for the same period at the then-current price unless canceled at least 24 hours before the end of the period.
- Cancel: iOS: Settings → Apple ID → Subscriptions. Android: Google Play → Payments & subscriptions → Subscriptions. The "Manage subscription" button in the App opens the same screen. Deleting the account does not cancel the subscription.
- Refunds: handled under the store's refund policy.
- Restore purchases on another device under Settings → Parents → Restore purchases.
4. Account
An account is optional and can only be created by a grown-up. Keep your sign-in details confidential. You can delete the account at any time in the App or on this page.
5. Prohibited use
Reverse engineering, unauthorized copying, bypassing purchase or security mechanisms, or abusing the service is not allowed.
6. Limitation of liability
We build the App with care but cannot guarantee uninterrupted or error-free operation. To the extent permitted by law we are not liable for indirect damages. Your statutory consumer rights are not affected.
7. Changes and governing law
We may update these terms; the current version is published on this page. The laws of the Republic of Türkiye apply, without prejudice to mandatory consumer protection laws of your country.
